Agreement

These terms apply to mydoctor.social and the MyDoctor app, provided by MODERNUS HEALTH TECHNOLOGIES PRIVATE LIMITED. By using them you agree to these terms. Organisations that subscribe also sign an order form or accept a quote, which prevails over these terms if they differ.

Not for emergencies

MyDoctor does not provide emergency services. In an emergency call 108 or 112 in India, or 911 in the United States.

Accounts

Keep your sign-in details private and turn on two-step sign-in. You are responsible for activity under your account. Organisations are responsible for the people they add and the access they give.

Healthcare decisions

Clinical decisions are made by the treating clinician. AI drafts, safety warnings and reminders in the software support clinicians and must be reviewed by them.

Acceptable use

Do not misuse the service, try to break its security, upload unlawful content, send spam, or access records without a care relationship or permission.

Subscriptions and fees

Fees, term and number of doctors are as in your quote or order. Taxes (GST in India, sales tax where applicable) are extra unless stated. Prices are locked for the agreed term. Every plan also includes an onboarding fee in year one, a yearly account fee every year after, and a platform fee or revenue share on revenue recorded in MyDoctor, see Fees, platform fee & MyDoctor Pay, and Payments, cancellations & refunds.

Your data

Organisations own the records they create. You can download your data, and we return or delete it when a subscription ends, as described in the privacy policy and your agreement.

Availability

We work to keep MyDoctor available and to back it up daily, but planned maintenance and events outside our control can interrupt service.

Liability

To the extent the law allows, MyDoctor's total liability is limited to the fees paid for the service in the 12 months before the claim, and we are not liable for indirect or consequential loss.

Optional Tips and Global Health Mission Supporter Passes

Customers may add an optional tip to a purchase or buy a MyDoctor Global Health Mission Supporter or Business Supporter pass. These are payments to MODERNUS HEALTH TECHNOLOGIES PRIVATE LIMITED, a for-profit company. They are company income, subject to applicable taxes, and non-refundable. They are not donations, are not tax-deductible or CSR-eligible, and are not investments; they give no shares, ownership or financial return. The Company may use these amounts for its startup work and for its MyDoctor Global Health Mission in India and around the world, and may add funds from its own income.

Payments and card authorisation

Payments are processed by Razorpay (India) or Stripe. We are not liable for any loss or damage arising directly or indirectly from a declined authorisation for any transaction because the cardholder exceeded the limit agreed with their bank. Prices on our websites are in Indian rupees unless another currency is shown.

Law and disputes

For customers in India these terms follow Indian law and courts at Ahmedabad, Gujarat have jurisdiction. For customers in the United States, the governing law is stated in your order form.
